It is also important to note that commercial tenants have limited defenses to an eviction unlike residential tenants because the warranty of habitability does not apply to commercial tenancies. However, commercial tenants may have additional rights if granted in the commercial lease such as longer periods of notice (a 5 Day Notice to Pay Rent or Quit instead of a 3 Day Notice).
