Glendale Owner Occupancy Eviction

The city of Glendale gives Landlords the option to recover possession of their property if they are seeking in good faith to use the rental unit for occupancy by either a resident manager, the Landlord themselves (including spouse, grandparents, brothers, sisters, in laws, children or parents).
It is important to note that the unit MUST be owned by a natural person. This means that if the unit is owned by a corporation or some other entity then this mode of eviction cannot be used.

Length of Notice

For Owner Occupancy Eviction’s Landlords must provide tenants with a notice period of 30 days if the tenant has lived there for less than 1 year. If the tenant has been there for over a year then a 60-day notice is required.

Relocation Assistance

Since owner occupancy evictions are considered to be no fault evictions, then the Landlord is required to pay a relocation fee. These relocation fees are intended to assist the now displaced tenants in finding new housing. The formula used to calculate the relocation fee in the city of Glendale is 3 x the greater of the amount of the current rent of Fair Market Rent (FMR) for a rental unit of similar size + $2,000.00). Qualified Tenant

It is also important to know that if your tenant is considered a qualified tenant than the relocation amount needs to be doubled. A qualified tenant is a tenant who is either a low-income tenant or a very low-income tenant. Additionally, they must also be 70 years of age or disabled or handicapped, or if there is a School-Aged child living in the unit.
