The city of Burbank is often called the “Media Capital of the World” because it is home to some of the most iconic media companies, including major Hollywood studios like Warner Bros., Disney, and NBC. What is Substantial Remodel Eviction?
According to Assembly Bill 1482,
“the replacement or substantial modification of any structural, electrical, plumbing, or mechanical system that requires a permit from a governmental agency, or the abatement of hazardous materials, including lead-based paint, mold or asbestos, in accordance with applicable federal, state, and local laws, that cannot be reasonably accomplished in a safe manner with the tenant in place and that requires the tenant to vacate the residential real property for at least 30 days.”
(Civ. Code § 1946.2(b)(2)(D)(ii))
It is also important to note that cosmetic improvements and minor repairs alone do not qualify as substantial remodel.
Substantial Remodel Evictions in Burbank
The city of Burbank has made it clear that they have adopted AB1482 but have strengthened it to give tenants more protection than the original assembly bill. These stricter protections include:
- Higher Relocation assistance for tenants who are displaced due to substantial remodel
- Building Permits must be secured from the city and/or local, state, federal agencies
- Tenant Must be provided with copies of building demolition, and/or any required hazardous abatement permit.
- Tenant must be provided with a written detailed account of the scope of work, why the work cannot be reasonable accomplished in a safe manner with the Tenants remaining in place, and why the work can’t be completed within thirty (30) days.
Burbank also requires Landlord’s to pay Tenant’s a minimum relocation amount that covers at least 3 months of their rent.
